These terms and conditions of sale apply to all sales concluded on the website www.nibs-plus-ultra.com subject to the specific conditions indicated in the presentation of the products.

ARTICLE 1 : legal notice

The website  www.nibs-plus-ultra.com is an online shop for:

hereinafter “Nibs Plus Ultra” or “we”.

The above address is a mailing address only. Nibs Plus Ultra does not have a retail shop open to customers.

The website is hosted by the company o2switch, whose registered office is located at 222-224 boulevard Gustave Flaubert in 63000 Clermont-Ferrand, France – telephone number: 00 33 444 44 60 40.

ARTICLE 2 : Essential characteristics of the products and services sold

The website www.nibs-plus-ultra.com offers for sale:

  • fountain pens

  • inks (bottles, cartridges)

  • paper

  • fountain pen and desk accessories

The customer, hereinafter “the buyer” or “you”, declares that he/she has read and accepted the general terms and conditions of sale before placing his/her order. The validation of the order is therefore considered as acceptance of the terms and conditions.

In the photos we take, our products are often shown with other products (a fountain pen may be shown with a bottle of ink and a notebook). Products used as illustrations are not included in the price of a product under any circumstances. Please refer to the characteristics of each product sheet.

ARTICLE 3 : Prices

The prices of the products are indicated in Euro including all taxes.

If you live in a country outside the Euro zone, the price of the products will be displayed without tax when you place your order and when you enter your delivery address. Your geographical location exempts you from paying VAT in France. However, you are liable for VAT and customs duties in your country of residence if the authorities ask you to pay them.

Delivery costs are not included in the sale price of the products. They are indicated during the ordering process and vary according to the weight of the package.

For all orders to Metropolitan France, Corsica, the other countries of the European Union, Monaco and Andorra and whose amount is greater than or equal to 120€, the shipping costs for standard delivery are offered.

ARTICLE 4 : Availability of products

The availability of a product is shown in the right-hand column next to the product picture. If the product in question is a fountain pen, you must first choose the nib size for the availability to appear.

  • if the mention “in stock” appears: the product is in stock and will be sent to you within 24 hours
  • if the mention “available on backorder” appears: the product is not in stock, we will order it from our supplier as soon as we receive your order. The delivery time is indicated in each product sheet (at the bottom of the “description” section)
  • if the mention “out of stock” appears: the product is not in stock and is either temporarily unavailable from our supplier or sold out.

In order to meet our customers’ expectations, the availability of products is updated on a daily basis.

ARTICLE 5 : Ordering

You can order the products directly on our website from Monday to Sunday, 24 hours a day. If the order is placed at the weekend or on a public holiday, it will be processed on the next working day.

To place an order, select the items and add them to the shopping cart, choose the delivery method and then confirm the order and fill in the delivery address. You also have the option to log in to the site if you have a customer account or create one during the checkout process.

You will then be asked to choose a payment method and tick the box accepting the terms and conditions before confirming the payment. Please check the details and total amount of your order before accepting.

You will receive an email confirming your order at the address you have indicated in the contact form.

Your order will be dispatched within 24 hours of receipt of payment (excluding weekends and public holidays), if the products are in stock. For products that are not in stock, they will be shipped within 24 hours after receipt in our premises.

After receiving your order, you will receive an e-mail offering you the opportunity to leave a review on our site regarding the products you have purchased. 

ARTICLE 6 : Delivery – carriers, zones, times, rates, customs

We do our utmost to find the best shipping conditions and the best rates for our customers. We work with demanding transporters who respect the delivery times they have agreed to. However, it may happen that the delivery time is slightly extended due to unforeseen circumstances beyond our control or that of the carrier.

We work with the following carriers: La Poste, Chronopost, Mondial Relay.

6.1 Geographical areas

We ship our products to the following countries:

Albania, Andorra, Armenia, Austria, Belarus, Belgium, Bosnia-Herzegovina, Bulgaria, Canada, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Georgia, Germany, Greece, Guadeloupe, French Guiana, Hungary, Ireland, Italy, Japan, Latvia, Lebanon, Lithuania, Luxembourg,  Malta, Martinique, Mayotte, Moldova, Montenegro, Monaco, New Caledonia, Northern Macedonia, Norway, Poland, Portugal, Reunion, Romania, Saint Barthélemy, Saint Martin (French part), Saint Pierre and Miquelon, Serbia, Slovakia, Slovenia, South Corea, Sweden, Switzerland, The Netherlands, the United Kingdom, Ukraine, the United States, Vatican, Wallis and Futuna

The delivery takes place at the address that you will have indicated at the time of your order.

6.2. Free shipping

For all orders to Metropolitan France, Corsica, the other countries of the European Union, Monaco and Andorra and whose amount is greater than or equal to 120€, the shipping costs in standard delivery are offered.

6.3. Delivery times and prices

When possible, we offer several delivery options: delivery to a relay point or to your home, as well as standard or express delivery.

6.3.1 Shipping to Metropolitan France

We offer you the choice between:

  1. a delivery in a relay point:
  • standard with Mondial Relay: 3 days ; cost of 5,65€ for a parcel from 0 to 0,500 kg
  • express with Chronopost: 24h ; cost of 11,34 € for a parcel from 0 to 2 kg
  1. home registered delivery against signature:
  • standard with La Poste: 48h ; cost of 12,10€ for a parcel from 0 to 0,250 kg
  • express with Chronopost: 24h ; cost of 17,64€ for a parcel from 0 to 2 kg

6.3.2 Shipping to Corse

We offer you the choice between:

  1. a standard delivery in relay point with Mondial Relay : 5 days ; cost of 5,65€ for a parcel from 0 to 0,500 kg
  2. a standard home registered delivery against signature with La Poste : 3 days ; cost of 12,10€ for a parcel from 0 to 0,250 kg

6.3.3 Shipping to French Guiana, Guadeloupe, Réunion, Martinique, Saint Barthélemy and Saint-Martin (French part)

The registered delivery is made at home against signature with La Poste : 5 days ; cost of 18,06€ for a parcel from 0 to 0,500 kg.

6.3.4 Shipping to Mayotte, New-Caledonia, Saint-Pierre and Miquelon, Wallis and Futuna

The registered delivery is made at home against signature with La Poste : 7 days ; cost of 26,02€ for a parcel from 0 to 0,500 kg.

6.3.5 Shipping to Monaco

We offer you the choice between:

  1. an express delivery in relay point with Chronopost : 24h ; cost of 11,34€ for a parcel from 0 to 2 kg
  2. home registered delivery against signature:
  • standard with La Poste : 48h ; cost of 12,10€ for a parcel from 0 to 0,250 kg
  • express with Chronopost : 24h ; cost of 21,60€ for a parcel from 0 to 2 kg

6.3.6 Shipping to Andorra

We offer you:

  • an Express home registered delivery against signature with Chronopost : 24h ; cost of 39,89€ for a parcel from 0 to 1 kg

6.3.7 Shipping to Belgium and Luxembourg

We offer you the choice between:

  1. a delivery in a relay point with Mondial Relay:
  • standard : 3 days ; cost of 5,82€ for a parcel from 0 to 0,500 kg
  1. a home registered delivery against signature:
  • standard with Mondial Relay : 3-5 days ; cost of 10,97€ for a parcel from 0 to 0,500 kg
  • express with Chronopost : 48h ; cost of 17,69€ for a parcel from 0 to 1 kg

6.3.8 Shipping to Germany

We offer you the choice between:

  • a standard home registered delivery against signature with Mondial Relay : 3-5 days ; cost of 10,97€ for a parcel from 0 to 0,500 kg

  • an Express home registered delivery against signature with Chronopost : 48h ; cost of 17,69€ for a parcel from 0 to 1 kg

6.3.9 Shipping to Spain

We offer you the choice between:

  1. a standard delivery in relay point with Mondial Relay : 3 days ; cost of 8,16€ for a parcel from 0 to 0,500 kg
  2. a home registered delivery against signature :
  • standard with Mondial Relay : 3-5 days ; cost of 11,71€ for a parcel from 0 to 0,500 kg
  • express with Chronopost : 48h ; cost of 18,59€ for a parcel from 0 to 1 kg

6.3.10 Shipping to Austria, Italy, Ireland and Portugal

The delivery is made at home against signature with La Poste: 3 days; cost of 14,47€ for a parcel from 0 to 0,500 kg

6.3.11. Shipping to Bulgaria, Cyprus, Croatia, Finland, Greece, Iceland, Malta and Romania

The registered delivery is made at home against signature with La Poste : 3 days ; cost of 18,79€ for a parcel from 0 to 0,500 kg.

6.3,12 Shipping to Denmark, Estonia, Hungary, Latvia, Lithuania, Poland, Czech Republic, Slovakia, Slovenia and Sweden

The delivery is made at home against signature with La Poste: 3 days; cost from 16,18€ for a parcel from 0 to 0,500 kg.

6.3.13 Shipping to Saint-Marin and Vatican

The delivery is made at home against signature with La Poste : 3 days ; cost of 14,12€ for a parcel from 0 to 0,500 kg.

6.3.14 Shipping to the United Kingdom

The delivery is made at home against signature with La Poste : 3-5 days ; cost of 19,08€ for a parcel from 0 to 0,500 kg.

6.3.15 Shipping to  Norway

The registered delivery is made at home against signature with La Poste : 3 days ; cost of 18,79€ for a parcel from 0 to 0,500 kg.

6.3.16 Shipping to Switzerland

The registered delivery is made at home against signature with La Poste : 3 days ; cost of 16,26€ for a parcel from 0 to 0,500 kg.

6.3.17 Shipping to Albania, Armenia, Bosnia-Herzegovina, Georgia, Northern Macedonia, Moldova, Montenegro and Ukraine

The registered delivery is made at home against signature with La Poste : 3 days ; cost of 21,08€ for a parcel from 0 to 0,500 kg.

6.3.18 Shipping to Belarus, Lebanon and Russia

Home delivery against signature with La Poste: time 3-5 days; cost from 42,91€ for a parcel from 0 to 0,500 kg.

6.3.19 Shipping to Canada, Japan, South Corea, and the United States

Delivery is made at home against signature with La Poste: time 3-5 days; cost from 37,98€ for a parcel from 0 to 0,500 kg.

6.3.20 Shipping to all other countries mentioned in point 1

The registered delivery is made at home against signature with La Poste : 5-12 days ; cost of 17,56€ for a parcel from 0 to 0,500 kg.

Note 1: for home delivery, in case of absence, a notice will be left in your mailbox so that you can pick up your parcel at the post office closest to your home. Any parcel not collected within the time limit set by the deliveryman will be returned to us. The cost of the return will be deducted from the refund of your order.

Note 2: Chronopost and Mondial Relay do not deliver on Saturday

6.4. Customs fees

In the case of an order delivered to a country other than France, you are the importer of the products you purchase. For all products shipped outside the European Union, you alone are responsible for declaring and paying any customs duties that may be due in your country.

6.5. Shipment tracking

As soon as your order has been dispatched, we will send you an email with a tracking link.

6.6. Damage

We prepare the orders with care, respecting the products we send so that you receive them in perfect condition. Your products are perfectly protected (recyclable bubble wrap, packing particles made from recyclable corn starch, etc.).

If a package arrives damaged, we advise you to check the condition of the products inside.

In the event of a lost parcel, we will send you the same parcel, free of charge.

ARTICLE 7 : Terms of payment

You can pay in several ways: by bank card (Visa, Mastercard, American Express), with Apple Pay, Google Pay, PayPal (4 times free of charge) or by bank transfer for payments in euros.

If you pay by bank card, you must indicate the 16 digits of your card number, its expiry date and the cryptogram (the 3 digits written on the back of the card). The online payment is secured by the AES-256 bits encryption level which allows your banking data to be encrypted during the online payment (more precisely, your banking data changes 256 times per second). Since they do not circulate in clear text on the Internet, they cannot be intercepted in any way. Your bank details are never communicated to us.

If you pay with PayPal, you have the possibility to pay in 4 instalments free of charge.

ARTICLE 8 : Right of withdrawal – Return

In accordance with article L121-20 of the French Consumer Code, you have the right to cancel your order within 14 days of receiving the item. You do not have to give any reason or pay any penalties.

The right of withdrawal does not apply to products made to your specifications or to personalised products.

To exercise your right of withdrawal, you have a total of 28 days after receipt of your order to return the package:

  • 14 days to inform us of your wish to return the product by sending an email to [email protected]
  • 14 days to return the package, the return costs being at our charge for shipments in the European Union, Monaco and Andorra.

We will inform you of the reception of your package. You will be reimbursed within 5 days of receipt by the same means used to pay for your order, provided that the product is in perfect condition and unused. If applicable, the shipping costs you paid when you placed your order will also be refunded.

You can use the return label provided by Nibs Plus Ultra for the choice of carrier. You can also use your own return label. In this case, if the parcel inadvertently does not arrive at its destination, Nibs Plus Ultra cannot be held responsible for any loss and your product will unfortunately not be refunded.

In order for the returned product to be sold again, it must be returned in its original packaging and condition, and in perfect condition. The product will be carefully examined on receipt at our premises. Any product returned incomplete, damaged (impacts, scratches, indelible marks due to untimely rubbing, etc., or forced or broken object, etc.), crumpled, soiled, dented or stained, will not be reimbursed. Fountain pens must not have been filled or inked under any circumstances. Any trace of ink in the feeder, the converter or on the nib will result in a fee for the complete cleaning of the fountain pen of €60 including VAT. These costs will be deducted from the amount to be refunded. Any fountain pen received sealed will not be accepted for return if the protective plastic packaging has been removed. The nibs of the pens will also be carefully checked with a monocular magnifying glass. If the returned product does not meet the above conditions, it can no longer be sold. It can therefore be returned to you at your request. The shipping costs (including postage) will then be at your charge, the amount will be communicated to you.

Any special order of a product not listed on our site is not eligible for the return policy.

ARTICLE 9 : Conformity of the products

You benefit from the legal guarantees of conformity and hidden defects, in accordance with the legal provisions in force. If you find that the product you have received, after ordering on our site, is defective, we invite you to send us an e-mail to [email protected] explaining the details of the non-conformity of the product. We will offer to repair the product by sending it back to the manufacturer. The return costs will be at our expense.

ARTICLE 10 : Conditions and time limits for reimbursement

The refund of the products is carried out by the same means used at the time of your order. It will take place within 3 days after receipt of the product in our premises.

ARTICLE 11 : Consumer complaints

Any complaint of the consumer is to be addressed by electronic way to [email protected].

ARTICLE 12 : Intellectual property

All comments, images and illustrations on our site are exclusively reserved to us. Under the intellectual property and copyright laws, any use is prohibited except for private use. The descriptions of the products on our site are protected by copyright laws.

Without prior authorisation, any reproduction of our site, whether partial or total, is strictly forbidden.

ARTICLE 13 : Liability

In accordance with Article 1147 of the Civil Code, we are contractually liable to you in the event of non-performance or poor performance of the contract concluded.

However, our contractual responsibility cannot be engaged in the situations mentioned below:

  • case of force majeure

  • a foreign event for which we cannot be held responsible

Furthermore, we endeavour to photograph our products as realistically as possible. However, they may differ slightly from the products you have ordered. They therefore have no contractual value and we cannot be held responsible.

ARTICLE 14 : Personal data

Nibs Plus Ultra is entirely responsible for the collection of personal data on the site www.nibs-plus-ultra.com.

In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the General Data Protection Regulation (GDPR), which came into force on 25 May 2018, we collect your personal data for the purpose of processing and dispatching orders and sending out our electronic newsletter.

The persons concerned are those who have placed an order on our website (buyer) and those who have subscribed to our newsletter.

Categories of data :

  • identity : title, surname, first name, address, delivery address, telephone number, e-mail address, internal processing code allowing the identification of the buyer, data relating to registration on opposition lists

  • data relating to orders: transaction number, details of purchases, amount of purchases, data relating to the payment of invoices (payments, outstanding payments, discounts), product returns

  • data relating to means of payment: bank card number, expiry date of the bank card, visual cryptogram (which is immediately deleted)

  • data necessary to carry out loyalty and prospecting actions: purchase history.

The recipients of your personal data are Nibs Plus Ultra and, in the case of an order on our site, the payment service provider and the carrier who will deliver your order. We will never share your data with third parties.

Nature and duration of data retention:

  • data necessary for the management of orders and invoicing: for the entire duration of the commercial relationship and 10 years for accounting purposes

  • data necessary to carry out loyalty actions and canvassing: for the entire duration of the commercial relationship and 3 years from the last purchase

  • data relating to means of payment: this data is not kept by Nibs Plus Ultra; it is collected at the time of the transaction and is immediately deleted as soon as the order is settled

  • data concerning the lists of opposition to receiving canvassing: 3 years.

You may at any time object to receiving emails from us by logging into your personal space or by clicking on the unsubscribe link at the bottom of each newsletter.

We take all necessary measures to ensure that your data is protected. Furthermore, your data will never be communicated to third parties other than those mentioned above who need your data to process your order and ensure its delivery.

ARTICLE 15 : Jurisdiction and applicable law

In the event of a dispute between the buyer and Nibs Plus Ultra, the applicable law is French law. The French courts shall have sole jurisdiction to settle the dispute.
